| Facts of the Case : |
| On 7th November, 12, the above noted perpetrators with CNG- vehicle were waiting for Ms.Shapla Rani Das (14) with ill motive while she was returning from her Janakallayan High School towards her house at Sadalpur. At about 4.30 p.m. while she was entering into the gate of her home suddenly those perpetrators intercepted, terrorizing prevented her movement anywhere. Ms. Shapla cried loudly but she could not resist those perpetrators because her mouth was tied up with napkin. This incident was witnessed by 1) Fazlu Meah son of late Moklus Meah, 2) Zangir Hossain son of Masuk Meah, 3) Mohibur Rahman son of late Ziazur Rahman of Baraigao, 4) Kalpana Rani Das (40) wife of Shashanka Das of Sadalpur of Biswanath Upazila of Sylhet Districts. Sagar Das (26) son of Shahanka Das – elder brother of the victim lodged F.I.R. at Biswasnath Police station on 10.11.2012 being case No.09 dated 10.11.12 under section 7/30 of Women and Children Repression Act, 2003 against those perpetrators. |

| Today, ( December 7,2012 )as per appeal submitted by mother, father of victim girl, I, Adv. Rabindra Ghosh, along with Rakesh Roy, HRCBM and Atindra Nath Deb of BDMW proceeded towards Sylhet from Dhaka and visited the spot ( tinny road) where from the victim girl was kidnapped 500 meters away from her house, interrogated the witnesses namely 1) Fazlu Meah, 2) Zahangir Hossain, 3) Mohibur Rahman, 4) Khaled Ahmed, 5) Nishi Kanta Paul, 6) Ms. Kalpala Rani, 7) Sawpna Rani 8) Shelly Rani (12) Sawpan Das. Those witnesses categorically admitted the fact and some of them witnessed the scenery of kidnapping but they could not resist them as perpetrators were armed with pistol and deadly weapon. The mother of the victim was crying at the time of our interview and demanded her daughter to be recovered from the illegal possession of the Muslim perpetrators. She also anticipated that her daughter might be forcefully converted or trafficked to any other country for sale or for illegal prostitution. Her father also cried and said “my daughter is a minor girl aged about 14 years, she can not give consent to marry a Muslim boy who is not legally capable to make love to anybody, I want to get back my daughter from the hand of perpetrators please help us” All the vocal statements of the witnesses were recorded in our video camera. At the time of our investigation the I.O. of the case was present. We have also met with Md. Abul Kalam Azad, Officer in Charge of Biswanath Police station, Md. Arifullah – Investigating officer of the case at his office at about 1 p.m. and wanted to know why the victim was not rescued and why the perpetrators have not yet been arrested by police despite a considerable time has already elapsed. O.C. informed us that the perpetrators are from nearest district of Sumamgonj far away from his Police station and the victim is still absconding and he will take prompt action henceforth for rescue of the victim. He also said that there was a love between the victim and accused. We posed question whether the victim had love with four perpetrators at a time – the O.C did not answer our question. We also put question on him why a Muslim victim Ms. Helena Begum (18) daughter of Abul Meah of Pratabpur of his jurisdiction was recovered who was kidnapped reportedly on 11.10.2012 kidnapped and recovered on 14.10.12 in connection with case No.13 dated 14.10.12 of Biswanath police station. Is it not the discrimination? The O.C. did not reply. We also got information that perpetrators of Ms.Shapla Rani’s case intimidated and threatened the informant – complainant over phone on 15.11.12 demanding immediate withdrawal of abduction case. Due to such threat/intimidation informant-Sagar Das appraises this matter to the Investigating Officer on 15.11.12 and he also made written allegation for taking necessary steps. But it is strange that the I.O. of case did nothing to investigate. We also brought the matter to the knowledge of the Officer in Charge for taking necessary action against his I.O. for not recording the matter as general diary. We made a general diary No.232 dated 07.12.12 on this serious allegation of suppressing facts against the perpetrators by the I.O. of the case. |

| Police took no action against the perpetrators nor the victim recovered till date. But a Muslim victim in a similar case Ms. Helena Begum (18) was traced and handed over to legal guardian of the victim soon after the occurrence. We also informed the matter to Mr. Shakawat Hossain, Superintendent of Police, Sylhet and the D.I.G of Police, Mokbul Hossain Bhuiya,Sylhet Range regarding such discrimination, but both the police officers denied any allegation of such discrimination. They gave us to understand that they will try to recover the victim girl within a short time. As per law the consent of the minor girl in any manner will not be accepted by any court of law in our country, so the contention of defense have got no foot to stand. |
